Acceptance

By downloading, installing, or using the KineSuite mobile application or the kinesuite.app website, you accept these terms. If you do not agree, we ask you not to use the service.

The website stores browser preferences and hosting/CDN may log aggregated visits (no clinical data). The mobile app uses no cookies — see our Privacy policy.

·02

Nature of the service

KineSuite is a professional-use application for physical therapists, rehabilitation professionals, and equivalent licensed titles in each country, as well as students and researchers. Its function is to assist in the administration and recording of standardized clinical assessment scales.

The application does NOT issue medical diagnoses, does NOT indicate treatments, and does NOT replace the clinical opinion of a professional licensed under the law of your jurisdiction. KineSuite is a support tool for clinical practice.

In its current version it is not an institution's official electronic medical record (EMR/EHR or local equivalent) or an immutable audit system: results can be edited or deleted without a cryptographic trail. Legal retention periods and formats for clinical records are the responsibility of the clinician and the institution under the regulations that apply to them.

Regulatory status: KineSuite is not designed or offered as a medical device, regulated software as a medical device (SaMD), or a system to diagnose, treat, or prevent disease, nor a substitute for in-person assessment. It is intended for healthcare professionals (or trainees under supervision) as a support tool for validated scales. Use by end patients without professional supervision is not intended.

·03

Validity of scales

Each scale implemented in KineSuite is based on its peer-reviewed published version. Where applicable, the PDF report (Pro tier) includes the DOI or reference of the original publication. The Free tier (app version 1.0.0) includes the core pack of one hundred instruments (001–100) across neurology, geriatrics, MSK, cardiorespiratory, and other areas; an expanded catalog (No. 101+) may be offered on Pro or specialty packs.

The clinician is responsible for applying each scale in the appropriate clinical context and for interpreting the results in line with their professional judgment and the available evidence.

·04

Scores and clinical flags

The scores, classification flags (Normal · Caution · Risk), and interpretive notes provided by KineSuite are referential and based on published cut-off points for each scale. Application to the specific case and the final clinical decision always rest with the treating clinician.

·05

Patient data

In Pro mode, patient data —name, age, identifier, scores, and notes— is stored locally in SQLite on the device. In Free mode no clinical record is persisted. KineSuite does not transmit this information to its own servers in Pro v1.

Data handling, backups, and patient rights are described in our Privacy policy.

Technical support from the app (email or optional technical file) is initiated by you; the app does not send usage analytics or automatic crash reports. Do not include patient data in support messages.

·06

User responsibility

The user is responsible for:

  • The confidentiality of their device, including the use of a passcode, password, or biometrics.
  • Compliance with local regulation on sensitive and health data that applies to them (e.g. GDPR, LGPD, HIPAA, PIPEDA, national or state laws, professional-body rules, or employer policies).
  • Obtaining informed consent from the patient —or another lawful basis— where required by local regulation.
  • Backing up the data they consider essential, using export features the app provides (e.g. PDF in Pro), and meeting clinical record retention required by their facility, insurer, or local law.
  • Not treating the local KineSuite chart as the institution's official medical record; exporting and archiving per center policy.
·07

License of use

KineSuite grants you a limited, personal, non-exclusive, and non-transferable license to use the app on mobile devices under your control. Decompiling, reverse-engineering, redistributing, commercializing, or deriving works from the app is not permitted without express authorization.

The Free tier includes the core catalog (scales 001–100) and on-screen scoring. Pro (optional monthly subscription via App Store or Google Play) unlocks records, history, PDF export, and the extended catalog (pro-catalog, scales 101+), downloaded to the device after an active subscription is verified.

Pro subscription

  • Indicative price: USD 1.99/month (may vary by country and store currency).
  • 14-day free trial when offered by the store; after it ends, the subscription is charged unless cancelled beforehand.
  • Auto-renewal until you cancel. To cancel on Android: Google Play → profile photo → Payments & subscriptions → Subscriptions → KineSuite → Cancel. Cancellation takes effect at the end of the current paid period.
  • After Pro expires or is cancelled, you retain read-only access to records already on the device; new entries and exports are restricted until you renew.
  • Specialty kits (one-time non-consumable purchases) are separate products: they do not replace Pro and do not guarantee a chart if you only buy a kit on Free.

Exact prices, trial, and conditions are shown in the app and store listing before you confirm purchase.

·08

Limitation of liability

KineSuite is provided "as is" and "as available". To the maximum extent permitted by applicable law, KineSuite and its team are not liable for:

  • Clinical decisions made based on the use of the application.
  • Data loss due to device failure, accidental deletion, or absence of user-side backups.
  • Indirect, consequential, or lost-profit damages derived from use or inability to use the application.
·09

Intellectual property

The name, logo, interface, illustrations, texts, and source code of KineSuite are the property of their authors and are protected by applicable intellectual-property laws. Third-party trademarks mentioned (App Store, Google Play, scale names, collaborating institutions) belong to their respective owners.

·10

Governing law and disputes

KineSuite is offered internationally. Unless mandatory law in your country requires otherwise, these terms are governed by the laws of the software developer's country (currently Chile). Before starting court proceedings, please contact us to seek a good-faith resolution.

If you are a consumer in the European Union, United Kingdom, or another jurisdiction with mandatory consumer-protection rules, you retain rights that cannot be limited by contract (including, where required by law, access to courts or dispute mechanisms in your habitual place of residence).

For disputes not resolved informally and where no mandatory rule provides otherwise, the parties may submit to the competent courts at the developer's place of business or as otherwise required by applicable conflict-of-law rules for your relationship with us.

·11

Changes to these terms

We may modify these terms. Material changes will be announced on the website and, where applicable, inside the application. If you continue to use the application after a change, you are deemed to accept the new version.
